1. Introduction and Purpose

This Acceptable Use Policy ("AUP" or "Policy") establishes the standards of conduct and prohibited activities that govern all use of the Gostify platform, including the website at https://www.gostify.app/, all associated subdomains, APIs, AI assistant tools, and related services (collectively, the "Platform"), operated by White Town LLC ("Company," "we," "us," or "our").

This Policy applies to all Customers (registered account holders), their authorized users, and indirectly to Guests who interact with AI assistants deployed through the Platform. It is designed to protect the integrity, security, and availability of the Platform; safeguard the rights and safety of all users; ensure compliance with applicable laws; and maintain the trust and reliability of the Service.

This AUP is incorporated by reference into the Gostify Terms of Service. By accessing or using the Platform, you agree to comply with this Policy at all times. Violation of this Policy may result in immediate suspension or termination of your account, without refund, and may expose you to civil or criminal liability where applicable law permits.

We reserve the right to monitor use of the Platform to detect violations of this Policy. Monitoring does not constitute an obligation to detect or prevent all violations, and we do not assume liability for any failure to detect prohibited use.

2. Permitted Use

The Platform is designed and made available solely for the following legitimate purposes:

  • Configuring and operating an AI-powered guest communication assistant for short-term rental accommodation properties, including apartments, villas, studios, and other similar residential properties listed on platforms such as Airbnb, Booking.com, or managed independently
  • Automating responses to common guest inquiries about the Customer\'s property, including but not limited to check-in and check-out procedures, WiFi access details, parking instructions, property amenities, local recommendations, and house rules
  • Distributing a unique subdomain link and QR code to guests of the Customer\'s accommodation property for the purpose of facilitating guest communication
  • Reviewing analytics and usage data related to your deployed AI assistant
  • Managing your Gostify account, Subscription, and billing information
  • Contacting our support team for technical assistance or account management purposes

Use of the Platform for any purpose not explicitly listed above or not reasonably implied by the intended functionality of the Service is prohibited unless expressly authorized in writing by White Town LLC.

3. Prohibited Content

3.1 Unlawful and Harmful Content

You must not upload, submit, configure, or transmit through the Platform any content that:

  • Violates any applicable local, national, or international law or regulation, including laws relating to consumer protection, data privacy, advertising, accommodation licensing, and short-term rental regulations in your jurisdiction
  • Is defamatory, libelous, slanderous, or otherwise damaging to the reputation of any individual, company, or organization
  • Is obscene, pornographic, sexually explicit, or otherwise offensive in nature
  • Constitutes harassment, intimidation, bullying, or threatening communication directed at any Guest, third party, or member of our staff
  • Promotes, glorifies, or facilitates violence, self-harm, terrorism, or extremist ideologies
  • Incites discrimination, hatred, or violence based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Facilitates or promotes illegal activities, including unlicensed accommodation operation, tax evasion, money laundering, human trafficking, or drug distribution
  • Misrepresents the identity, qualifications, or legitimacy of the Customer, the property, or any affiliated individual or business

3.2 Misleading and Deceptive Content

You must not configure your AI assistant to:

  • Provide false, inaccurate, or materially misleading information to Guests about the property, its amenities, location, pricing, house rules, or any other aspect of the accommodation
  • Impersonate another individual, business, or service, or create a false impression that the AI assistant represents an entity other than the Customer\'s own accommodation business
  • Make warranties, guarantees, or representations on behalf of Gostify or White Town LLC
  • Claim or imply that the AI assistant is a human operator when a Guest sincerely asks whether they are communicating with a human or an automated system
  • Provide fictitious reviews, testimonials, or fabricated social proof about the property
  • Advertise or promote products, services, or third-party businesses unrelated to the Customer\'s accommodation property without explicit prior written approval from White Town LLC

3.3 Sensitive and Prohibited Data Collection

You must not configure the AI assistant to solicit, collect, or store from Guests any of the following categories of sensitive information:

  • Payment card numbers, CVV codes, bank account details, or any other full financial account information
  • Government-issued identification numbers, including passport numbers, national identity card numbers, social security numbers, or tax identification numbers
  • Biometric data, including fingerprints, facial recognition data, or voice prints
  • Health, medical, or disability information
  • Racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership
  • Sexual orientation or gender identity
  • Data relating to criminal convictions or offenses
  • Login credentials, passwords, or security codes for any platform, service, or device
  • Any information from individuals who identify themselves as or appear to be under the age of sixteen (16)

Collection of the above categories of data through the Platform is strictly prohibited regardless of whether the Guest provides such information voluntarily. If a Guest submits sensitive data unprompted, you must not store, use, or share that data and should configure your assistant to redirect such interactions appropriately.

4. Prohibited Technical Use

4.1 Platform Integrity

You must not engage in any technical activity that undermines the integrity, security, or availability of the Platform, including:

  • Attempting to gain unauthorized access to any part of the Platform, including other Customers\' accounts, backend systems, administrative interfaces, databases, or AI model configurations
  • Probing, scanning, or testing the vulnerability of the Platform or any associated systems or networks without explicit prior written authorization from White Town LLC
  • Reverse engineering, decompiling, disassembling, or attempting to extract source code, algorithms, model weights, training data, or proprietary logic from any part of the Platform
  • Circumventing, disabling, or tampering with any authentication mechanisms, access controls, rate limiters, or security features of the Platform
  • Introducing, uploading, or transmitting any viruses, worms, ransomware, spyware, trojans, or other malicious code or harmful software into the Platform or through it to Guests
  • Attempting to intercept, monitor, or capture data transmitted between the Platform and its users through man-in-the-middle attacks, packet sniffing, or similar techniques

4.2 Automated and Abusive Access

You must not use automated tools, scripts, or systems to access or interact with the Platform in a manner inconsistent with normal human use, including:

  • Using bots, crawlers, scrapers, or automated agents to access, extract, or index Platform content, including AI responses, analytics data, or configuration interfaces
  • Sending artificially generated or simulated guest messages to your AI assistant at volumes that exceed normal operational use for a single accommodation property, for the purpose of testing, benchmarking, gaming analytics, or any other non-genuine guest interaction purpose
  • Submitting automated or scripted requests to the Platform\'s API or frontend in a manner that creates an unreasonable or disproportionate load on infrastructure
  • Using the Platform as a proxy or relay to access third-party systems, services, or networks

4.3 Intellectual Property Violations

You must not use the Platform to:

  • Upload, transmit, or incorporate into your AI assistant configuration any content that infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party
  • Copy, reproduce, redistribute, or create derivative works from any part of the Platform software, user interface, documentation, or AI-generated output without prior written authorization from White Town LLC
  • Use the Gostify name, logo, trademarks, or branding in any manner not expressly permitted in writing, including in marketing materials, social media, or as part of a resold or white-labeled service

4.4 Resale and Unauthorized Commercial Use

Unless expressly authorized by a separate written agreement with White Town LLC, you must not:

  • Resell, sublicense, lease, or otherwise transfer access to the Platform or your Subscription to any third party
  • Operate the Platform as a white-label or private-label service offered to third parties under your own brand
  • Provide paid access to your AI assistant subdomain to third parties as a standalone service
  • Use a single Subscription to serve multiple unrelated properties or business entities beyond what is reasonably covered by a single accommodation listing

5. Guest Interaction Standards

5.1 Guest Rights and Dignity

All Customers are responsible for ensuring that their AI assistant treats Guests with dignity and respect. You must not configure the AI assistant in any manner that:

  • Discriminates against Guests on the basis of race, ethnicity, national origin, religion, gender, age, disability, sexual orientation, or any other protected characteristic in violation of applicable anti-discrimination laws
  • Engages in psychological manipulation, coercive communication, or deceptive tactics designed to pressure Guests into purchases, upgrades, or actions against their interests
  • Collects or processes Guest data for purposes unrelated to legitimate property-related guest communication without the Guest\'s informed consent
  • Directs Guests to share information or take actions that could compromise their security, privacy, or financial interests

5.2 Compliance with Short-Term Rental Regulations

Customers are solely responsible for ensuring that their use of the Platform and their accommodation operations comply with all applicable short-term rental regulations, licensing requirements, zoning laws, homeowner association rules, and platform-specific policies (such as those of Airbnb or Booking.com) in their jurisdiction. White Town LLC does not verify whether a Customer\'s accommodation operation is lawfully permitted and assumes no responsibility for regulatory compliance on the Customer\'s behalf.

5.3 Guest Privacy Obligations

As the data controller for Guest data processed through your AI assistant, you bear independent obligations under applicable data protection law, including the GDPR where applicable, to: provide Guests with an appropriate privacy notice before they interact with the AI assistant; establish a lawful basis for processing Guest data; respond to Guest data subject rights requests; and ensure that Guest data is not used for purposes beyond those disclosed to Guests. White Town LLC will assist you in meeting these obligations in its capacity as data processor, subject to the Data Processing Agreement.

6. Compliance with Laws and Third-Party Terms

You are solely responsible for ensuring that your use of the Platform complies with all applicable laws, regulations, and third-party terms of service, including but not limited to:

  • Data protection and privacy laws applicable in your jurisdiction and in the jurisdictions of your Guests, including the GDPR, CCPA, and equivalent national legislation
  • Consumer protection laws governing the accuracy of information provided to consumers in connection with accommodation services
  • Accommodation licensing, registration, and short-term rental regulations applicable in the location of your property
  • Anti-spam and electronic communications laws applicable to any messaging you distribute in connection with your AI assistant link or QR code
  • Terms of service of third-party platforms such as Airbnb and Booking.com, to the extent your use of Gostify is integrated with or referenced in those platforms
  • Export control laws of the United States and other applicable jurisdictions, if relevant to the nature of your use

White Town LLC does not provide legal advice and is not responsible for advising you on your compliance obligations. If you are uncertain about whether your intended use complies with applicable law, you should seek independent legal counsel.

7. Reporting Violations

If you become aware of any use of the Platform that appears to violate this Policy, including by other Customers or through misuse of a Gostify-powered AI assistant, we encourage you to report it to us promptly. Reports can be submitted by email to info@gostify.app with the subject line "AUP Violation Report."

Please include in your report: a description of the alleged violation; the URL or subdomain involved, if applicable; any supporting evidence such as screenshots or message logs; and your contact information. We will investigate all reports in good faith and respond where appropriate. We do not guarantee a specific outcome in response to any report and are not obligated to disclose the results of any investigation.

Submitting a false or malicious violation report in bad faith, for the purpose of harassing or disrupting another Customer\'s legitimate use of the Service, is itself a violation of this Policy.

8. Enforcement and Consequences

8.1 Enforcement Actions

White Town LLC reserves the right to take any of the following actions in response to a violation of this Policy, at our sole discretion and without prior notice where circumstances require immediate action:

  • Issue a formal warning to the Customer via email
  • Temporarily suspend access to the Platform or specific features pending investigation
  • Permanently terminate the Customer\'s account and Subscription without refund
  • Remove, disable, or modify any Customer Content or AI assistant configuration that violates this Policy
  • Report the violation to relevant law enforcement agencies, regulatory authorities, or third-party platforms where the violation involves illegal activity
  • Pursue civil legal action to recover damages, costs, or losses resulting from the violation

8.2 Factors in Enforcement Decisions

In determining the appropriate enforcement response, we may consider factors including: the severity and nature of the violation; whether the violation was intentional or negligent; the impact of the violation on other users, Guests, or third parties; the Customer\'s history of compliance with this Policy and the Terms of Service; whether the Customer promptly remediated the violation upon notification; and any mitigating or aggravating circumstances communicated by the Customer.

8.3 No Waiver

Our failure to enforce any provision of this Policy in a specific instance does not constitute a waiver of our right to enforce that provision in the future or in other instances. The absence of enforcement action does not imply that a particular use is permitted.

8.4 Appeals

If you believe your account has been suspended or terminated in error or that an enforcement action was applied unfairly, you may submit an appeal by email to info@gostify.app within fourteen (14) days of receiving notice of the enforcement action. Your appeal should include your account email address, a description of the enforcement action taken, and your explanation of why you believe the action was in error. We will review appeals in good faith and respond within ten (10) business days. Our decision on appeal is final.

9. Customer Responsibility for Third Parties

You are responsible for ensuring that any individuals you authorize to access your Gostify account, manage your AI assistant configuration, or distribute your subdomain link or QR code comply with this Policy in full. Violations committed by authorized users of your account are treated as violations by you for enforcement purposes.

You are also indirectly responsible for ensuring that the use of your AI assistant by Guests does not result in outcomes that violate this Policy. While you cannot control every Guest interaction, you are responsible for configuring your AI assistant in a manner that minimizes the risk of harmful, deceptive, or unlawful outputs, and for updating your configuration promptly if issues are identified.

10. Updates to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in legal requirements, Platform capabilities, industry standards, or identified risk areas. Material updates will be communicated to Customers via email at least fourteen (14) days before the updated Policy takes effect. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Policy.

The current version of this Policy is always available at https://www.gostify.app/. We encourage you to review this Policy periodically, particularly when you make significant changes to your AI assistant configuration or expand your use of the Platform.
