1. Introduction

This Disclaimer governs the use of the Gostify platform, including the website at https://www.gostify.app/ and all Gostify-powered AI assistant subdomains (collectively, the "Platform"), operated by White Town LLC ("Company," "we," "us," or "our"). This Disclaimer applies to all Customers (registered account holders) and to all Guests (third parties who interact with a Customer\'s AI assistant through a subdomain link or QR code).

This Disclaimer is incorporated by reference into the Gostify Terms of Service and forms part of the legal framework governing use of the Platform. By accessing or using the Platform, or by interacting with a Gostify-powered AI assistant, you acknowledge that you have read, understood, and agreed to the terms of this Disclaimer. If you do not agree with any part of this Disclaimer, you should not use the Platform or interact with any AI assistant powered by Gostify.

This Disclaimer supplements, and does not replace, the disclaimers and liability limitations set out in the Terms of Service and other legal documents published by White Town LLC. In the event of any conflict between this Disclaimer and the Terms of Service with respect to the subject matter covered herein, the Terms of Service shall prevail.

2. Nature of the Gostify Service

Gostify is a software-as-a-service platform that enables property owners and managers to deploy AI-powered chatbot assistants for the purpose of automating guest communication at short-term rental accommodation properties. The AI assistant is a tool designed to reduce the manual workload associated with responding to common guest inquiries. It is not a substitute for professional advice, emergency services, human judgment, or direct communication with the property owner or manager in situations requiring such.

The Gostify Platform is a technological intermediary. White Town LLC provides the software infrastructure, AI processing capability, and delivery mechanism for the AI assistant. The content, configuration, and accuracy of information provided by any specific AI assistant deployed on the Platform is the sole responsibility of the Customer who configured that assistant. White Town LLC does not review, validate, or approve the content of individual AI assistants prior to their deployment.

The AI assistant operates by processing natural language input from Guests and generating automated responses based on information provided by the Customer during the setup process and the capabilities of the underlying AI model. Responses are generated algorithmically and without human oversight of individual interactions. The AI assistant does not have access to real-time information, live booking systems, payment platforms, emergency services, or any external data source unless such integration is explicitly and separately provided as a Platform feature.

3. AI Response Accuracy Disclaimer

3.1 No Guarantee of Accuracy

The responses generated by the Gostify AI assistant are produced by automated systems and are not reviewed by a human operator before delivery to the Guest. While the AI assistant is designed to provide helpful and accurate responses based on the information configured by the Customer, White Town LLC makes no warranty, representation, or guarantee that any AI-generated response is accurate, complete, current, appropriate, or fit for any particular purpose.

AI-generated responses may be:

  • Incomplete: the AI may not address all aspects of a Guest\'s question, particularly if relevant information was not included in the Customer\'s configuration
  • Inaccurate: the AI may misinterpret a question, apply information incorrectly, or generate a response that does not reflect the actual state of the property or its policies
  • Outdated: the AI assistant responds based on information entered by the Customer at the time of configuration; if property details, policies, access codes, or amenity availability have changed since configuration, the AI may provide outdated information unless the Customer has updated its configuration
  • Contextually inappropriate: the AI may occasionally generate responses that, while technically based on configured information, are not well-suited to the specific context or phrasing of a particular Guest\'s question
  • Incomplete in edge cases: the AI assistant is optimized for common guest inquiries and may not adequately address unusual, highly specific, or complex situations that were not anticipated during configuration

3.2 AI Hallucination Risk

Large language model AI systems, including those powering the Gostify assistant, carry an inherent risk of generating responses that appear plausible but are factually incorrect or fabricated, a phenomenon commonly referred to as "hallucination." While Gostify\'s AI assistant is configured with specific property information to minimize this risk within its operational scope, no AI system is entirely free from this limitation.

White Town LLC takes reasonable technical measures to reduce the risk of inaccurate or hallucinated responses, including constraining the AI assistant to respond based on Customer-provided information. However, White Town LLC cannot guarantee that the AI assistant will never produce an inaccurate or misleading response, and expressly disclaims liability for any harm, loss, inconvenience, or damage arising from reliance on any AI-generated response.

3.3 Customer Responsibility for Content Accuracy

The accuracy of AI-generated responses is directly dependent on the accuracy and completeness of the information provided by the Customer during the setup process. Customers are solely responsible for: ensuring that all property information, amenity details, check-in instructions, house rules, local recommendations, and FAQ responses entered into the Platform are accurate and current; updating the AI assistant configuration promptly when property details change; and reviewing AI-generated responses periodically to identify and correct any inaccuracies.

White Town LLC is not responsible for AI responses that are inaccurate as a result of incorrect, incomplete, or outdated information provided by the Customer. Customers who are aware of recurring inaccuracies in their AI assistant\'s responses must update their configuration to correct those inaccuracies without delay.

3.4 Guest Reliance on AI Responses

Guests are advised that they are interacting with an automated AI assistant and not with a human property manager or operator. Guests should exercise their own judgment when acting on information provided by the AI assistant and should verify important information directly with the property owner or manager when the stakes of relying on that information are significant. AI-generated responses should not be treated as contractual commitments, guarantees, or legally binding statements by the Customer or by White Town LLC.

For matters involving safety, legal rights, contractual terms of accommodation, health emergencies, criminal activity, or financial transactions, Guests must contact the property owner, manager, or relevant emergency services directly and must not rely solely on information provided by the AI assistant.

4. No Professional Advice

4.1 Not Legal Advice

Nothing in any AI-generated response, on the Gostify website, or in any Platform-generated content constitutes legal advice. The Platform does not provide legal information, and no communication through the AI assistant should be construed as creating an attorney-client relationship or as legal counsel of any kind. Guests or Customers who require legal advice should consult a qualified attorney licensed in the relevant jurisdiction.

4.2 Not Medical or Safety Advice

Nothing in any AI-generated response constitutes medical advice, first aid guidance, emergency response instruction, or safety advice. In the event of a medical emergency, fire, criminal incident, or any other situation requiring immediate assistance, Guests must contact the relevant emergency services (such as 911 in the United States, 112 in the European Union, or the applicable local emergency number) immediately and directly. The AI assistant is not equipped to respond to emergencies and must not be used as a means of seeking emergency assistance.

White Town LLC expressly disclaims all liability for any injury, loss of life, property damage, or other harm arising from a Guest\'s failure to contact emergency services directly and relying instead on the AI assistant in an emergency situation.

4.3 Not Financial or Tax Advice

Nothing in any AI-generated response, on the Gostify website, or in any Platform communication constitutes financial advice, investment advice, tax advice, or accounting guidance. Customers requiring guidance on the financial or tax implications of their accommodation business should consult a qualified financial advisor or tax professional.

4.4 Not Accommodation or Travel Advice

While the AI assistant may provide local recommendations, directions, or information about nearby attractions at the Customer\'s direction, such information is provided for general informational purposes only. White Town LLC makes no representations regarding the accuracy, suitability, safety, or current status of any restaurant, attraction, transportation service, or other local recommendation provided by the AI assistant. Guests should independently verify the accuracy, hours of operation, availability, and safety of any recommended locations or services before relying on them.

5. Disclosure of Automated Processing

The Gostify AI assistant is a fully automated system. All responses to Guest queries are generated by artificial intelligence without real-time human review or intervention. Customers deploying Gostify AI assistants are responsible for ensuring that their Guests are aware, through appropriate disclosure in their listing descriptions, pre-arrival communications, or other means, that the assistant they are interacting with is an automated AI system and not a human operator.

If a Guest sincerely asks whether they are communicating with a human or an automated system, the AI assistant is configured to disclose its automated nature. Customers must not override or modify this disclosure behavior. White Town LLC expressly disclaims liability arising from any Customer\'s failure to inform Guests that they are interacting with an AI assistant or from any deliberate misrepresentation of the AI assistant as a human operator.

The automated nature of the AI assistant means that response quality, appropriateness, and accuracy may vary between interactions, and no two interactions with the same input are guaranteed to produce identical outputs. This inherent variability is a characteristic of AI language model systems and is not a defect or service failure on the part of White Town LLC.

6. Third-Party Content and External Links

The Gostify Platform and AI assistant may reference, link to, or incorporate information relating to third-party services, websites, platforms, businesses, or locations. Such references are provided for informational convenience only. White Town LLC does not endorse, verify, or assume responsibility for the content, accuracy, availability, safety, privacy practices, or terms of any third-party website, service, or business referenced through the Platform or by the AI assistant.

Links to third-party websites, including accommodation listing platforms such as Airbnb and Booking.com, are provided for informational purposes. Accessing these websites is at the user\'s own risk. The inclusion of a link to a third-party website does not imply any affiliation, partnership, or endorsement by White Town LLC.

Where the AI assistant provides local recommendations or references to external businesses or services at the Customer\'s direction, those recommendations are based solely on information provided by the Customer. White Town LLC has not independently verified the accuracy of such recommendations and is not responsible for any experience, loss, or harm arising from a Guest\'s decision to use a recommended third-party service.

7. Service Availability Disclaimer

White Town LLC does not guarantee uninterrupted, continuous, or error-free availability of the Platform or any AI assistant deployed through it. The Platform may be subject to temporary unavailability due to scheduled maintenance, unplanned technical failures, third-party service provider outages (including the AI model provider), infrastructure issues, or events beyond our reasonable control including force majeure events.

White Town LLC is not liable for any loss, inconvenience, harm, or damage suffered by a Customer or Guest as a result of the Platform being unavailable, an AI assistant being temporarily inaccessible, or an AI assistant failing to respond to a Guest query at any given time. Customers are responsible for ensuring that alternative means of Guest communication are available as a fallback in the event of Platform unavailability.

The accuracy, speed, and quality of AI responses may be affected by factors including the volume of concurrent requests, the performance of the underlying AI model infrastructure, and the completeness of the Customer\'s configuration. These factors are subject to variation and may not be consistent across all interactions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHITE TOWN LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

  • Any AI-generated response provided to a Guest through a Customer\'s AI assistant, whether accurate or inaccurate
  • Any action taken or not taken by a Guest in reliance on an AI-generated response
  • Any failure of the AI assistant to respond to a Guest query or to provide a complete or accurate response
  • Any misrepresentation of the AI assistant as a human operator by a Customer
  • Any inaccuracy in Customer-configured content that results in a misleading AI-generated response
  • Any temporary unavailability of the Platform or AI assistant
  • Any reliance by a Guest on AI-generated local recommendations, directions, or third-party references
  • Any emergency situation in which a Guest used or attempted to use the AI assistant instead of contacting emergency services
  • Any harm, injury, loss, or damage occurring at a Customer\'s accommodation property, regardless of whether the AI assistant provided information relevant to that harm

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH A CLAIM IS BROUGHT, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND APPLIES EVEN IF WHITE TOWN LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not permit the exclusion or limitation of certain types of damages, the above limitations apply to the fullest extent permitted by applicable law.

9. Customer Indemnification

Customers agree to indemnify, defend, and hold harmless White Town LLC and its members, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, fines, penalties, and expenses (including reasonable attorneys\' fees) arising out of or related to: (a) inaccurate, incomplete, or misleading information configured in the Customer\'s AI assistant; (b) the Customer\'s failure to update their AI assistant configuration to reflect changes in property details or policies; (c) the Customer\'s failure to adequately inform Guests that they are interacting with an automated AI system; (d) any interaction between a Guest and the Customer\'s AI assistant that results in harm, loss, or legal action; or (e) the Customer\'s violation of any applicable law in connection with their use of the Platform.

10. Intellectual Property Disclaimer

All content on the Gostify website, including text, graphics, logos, user interface designs, software, and documentation, is the property of White Town LLC or its licensors and is protected by applicable intellectual property laws. No content from the Gostify website or Platform may be reproduced, distributed, modified, or used for commercial purposes without prior written authorization from White Town LLC.

AI-generated responses produced by the Gostify assistant during Guest interactions are generated dynamically and are based on Customer-provided content and the output of third-party AI model systems. White Town LLC does not claim copyright ownership over individual AI-generated responses delivered to Guests. Customers retain responsibility for the content of responses generated based on their configuration inputs.

The Gostify name, logo, and associated trademarks are the property of White Town LLC. Use of these marks without prior written authorization is prohibited.

11. Jurisdiction-Specific Disclaimers

11.1 European Union and EEA

For users located in the European Union or European Economic Area, this Disclaimer does not limit any rights you have under mandatory consumer protection laws in your country of residence that cannot be excluded or limited by contract. In particular, nothing in this Disclaimer excludes liability for death or personal injury caused by White Town LLC\'s negligence, liability for fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited under EU or member state law.

11.2 United Kingdom

For users located in the United Kingdom, this Disclaimer is subject to the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015, as applicable. Nothing in this Disclaimer limits any liability that cannot be lawfully excluded under UK law, including liability for death or personal injury caused by negligence, or liability for fraud or fraudulent misrepresentation.

11.3 United States

For users located in the United States, some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages. In such states, the limitations described in this Disclaimer apply to the fullest extent permitted by the laws of the applicable state. Nothing in this Disclaimer creates additional warranties or representations beyond those provided in the Gostify Terms of Service.

11.4 Australia and Other Jurisdictions

Users located in Australia, Canada, or other jurisdictions with mandatory statutory consumer protections may have rights under applicable law that are not affected by this Disclaimer. This Disclaimer applies to the fullest extent permitted by the laws of the applicable jurisdiction, and any provision found to be unenforceable under mandatory local law shall be modified to the minimum extent necessary to make it enforceable.

12. Updates to This Disclaimer

White Town LLC reserves the right to update or modify this Disclaimer at any time to reflect changes in our services, legal obligations, or AI technology capabilities. Material changes will be communicated to Customers via email to the registered account address at least fourteen (14) days before the updated Disclaimer takes effect.

The "Effective Date" at the top of this Disclaimer indicates when it was last revised. The current version of this Disclaimer is always available at https://www.gostify.app/. Your continued use of the Platform after the effective date of any update constitutes acceptance of the revised Disclaimer.
